Terms of Use

The MERKUR SPIEL-ARENA is owned by the municipal company D.LIVE GmbH & Co. KG and is leased by the latter on the basis of a rental agreement to the Düsseldorf gymnastics and sports club Fortuna 1895 e.V. ("Fortuna Düsseldorf") on a non-exclusive basis at market conditions. In addition, the MERKUR SPIEL-ARENA is open for use as sports infrastructure by third parties on transparent and non-discriminatory terms. The usage options amount to at least 20% of the available usage times.

When authorizing third parties for use, it must be taken into account that Fortuna Düsseldorf is subject to obligations arising from the match operations of the 1st and 2nd Bundesliga, among others, as determined by the DFL Deutsche Fußball Liga GmbH. In the case of use by third parties, it must be taken into account that Fortuna Düsseldorf can fulfill such obligations. Thus, use by third parties on match days and on the day before/after the match is generally excluded. These restrictions apply accordingly in the case of participation in national and international cup competitions or other leagues. In all other respects, access is granted to all potential users (e.g. amateur sports) on the basis of this fee schedule in accordance with non-discriminatory and transparent principles within the framework of the regulatory and building regulations. Applications for use must be submitted in writing to D.LIVE GmbH & Co.

All users must observe the house rules as amended from time to time. These will be made available on request and can be downloaded from the D.LIVE GmbH & Co KG website.

This fee schedule shall enter into force on 01.01.2024 and shall be published. We reserve the right to make changes in the future. Special agreements are possible by arrangement. If, in individual cases, the stadium capacity is not expected to be fully utilized and/or the event is not primarily commercial in nature, different conditions may be agreed that take into account the nature of the individual event and comply with the principle of transparent and non-discriminatory access.

The prices are exclusive of ancillary costs and, where due, exclusive of VAT. After use, the user must return the areas used in the condition in which he/she took them over, this applies in particular to the lawns. Local cleaning and security services must be booked for this purpose; the costs shall be borne by the user. All objects of use shall not be left neutralized for advertising purposes. Any neutralization costs shall be borne by the user. If the entire stadium is used, one set-up and dismantling day is included in the price; each additional day is to be paid for as required. If the use of neighboring/other areas is impaired by the provision of individual items of use, the price of all affected items of use must be paid.

Any hospitality services cannot be provided by D.LIVE GmbH & Co. KG. The contact partner is Aramark Restaurations GmbH. Third-party providers can provide services by arrangement.
